Queens, New York (NewYorkInjuryNews.com) — At approximately 2:00 a.m. one cold winter night, a 20 year-old stock clerk named George (not his real name) was waiting along with two of his buddies for a train on the platform of the Queens Plaza station. It was the Christmas season so the three had a few drinks to celebrate the holidays. On the platform, three other men loomed nearby and remained quiet until the train arrived.
The doors opened and everyone boarded the same car. Suddenly, the three unnamed men accosted George and his friends, demanding their jackets, wallets and jewelry. When the train pulled into the 23rd Street Ely Avenue stop, George and one of his friends jumped from the car, but one other friend remained in the grasp of the perpetrators. In an attempt to rescue his friend, George reached back into the car when the train door closed on his wrist and jacket. The subway pulled away, and George was dragged 400 feet until he crashed into a wall at the end of the platform. He then fell onto the tracks and was ran over by the moving subway.
Miraculously, George survived, although he sustained horrible injuries including having his right hand amputated. George decided to take legal action and retained attorneys to sue the Transit Authority for his injuries. His claim was that the conductor failed to follow the required Transit safety procedure of looking up and down the platform before putting the train into motion. Had he done so he would have seen him stuck in the door and not started the train.
The firm obtained a substantial settlement for George after a trial, who no doubt because of the violence and trauma involved, could recall nothing of the accident – all he knew was that he right hand was gone and he was mangled and scarred all over his body. It was his friends who helped reenact for the jury how George so bravely put his life on the line to save a friend.
