Queens, NY (NewYorkInjuryNews.com) – A woman from Long Island suffered spine and head trauma when a supermarket shelf of jarred tomato sauce toppled over and buried the woman, announced the New York Daily News.
The woman who claims that the jars of spaghetti sauce were not properly stacked, has filed a lawsuit in Queens Supreme Court claiming that she sustained permanent injuries from the grocery store accident.
55-year-old Patricia Samaroo said that she was reaching up to get to the jar of sauce when the jars all collapsed on and around her on Jan. 19 at an Ozone Park Pathmark, where the accident occurred. She said that after the jars fell off the shelf, she was covered with spaghetti sauce. Emergency medical services (EMS) transported Samaroo to the local hospital where she was treated for trauma to her head and her spine, which was her claim in Queens Court.
She commented that the heavy jars of spaghetti sauce should be placed on a lower shelf to prevent this from happening again. Samaroo said that she still experiences pain in her neck and she has to take pain killers. Court documents showed that Samaroo suffered from bulging discs in her back and damage to her nerves, which made her sick, and disabled.
Samaroo’s lawyer commented saying that the supermarket manager neglected to determine if the jars were unstable and could possibly fail off the shelf. Pathmark failed to comment.
