A three year-old Gilchrist County resident was critically injured after he wandered into the reach of his family’s pit bull late afternoon on Thursday, October 1st. The dog, a 40+ pound male pit bull, was chained up in the yard at the time of the incident. After a family friend heard the boy screaming, the friend rushed to the scene and found the dog on top of the toddler. The family friend turned rescuer was forced to literally wrestle the dog off of the little boy. After the pit bull was successfully removed from atop the child, paramedics were called and responded to the scene.
Due to the severity of the child’s injuries, the EVAC staff called for a helicopter to airlift the child to Shands Hospital at the University of Florida. The boy’s injuries have been described as “not life-threatening but life-altering.” The Department of Children and Families was notified of the mauling and is looking into the case. It remains a possibility that the parents of the child will be charged with violations of child abuse and neglect laws. As for the dog, it was taken into custody by Gilchrist County Animal Services. It has been reported that the boy’s family told officials at the scene that they wished for the dog to be euthanized.
It is a harsh reality in our community that there are times when the pets we love and adore act out in ways we would never imagine. Occasionally, an animal’s momentary rage is directed toward a person or persons and results in injury. In a matter of seconds, an individual’s life may be forever changed when a dog becomes overly aggressive. Due to the magnitude of the impact such an event may have on one’s life, it is vital that you hire a law firm with the experience and knowledge necessary to execute your injury claim in the manner most likely to provide you and your family the necessary compensation shall the need arise.
Oftentimes, homeowner’s insurance policies provide coverage for dog bite related injuries. While some insurance carriers exclude certain breeds of dogs from such coverage, an attorney is essential to determining whether coverage exists and if so, to what extent it can provide for a recovery. Alternatively, dedicated lawyers and staff members will conduct a thorough investigation to determine how to best proceed against the responsible parties if there is an absence of coverage or if an exclusion applies. Remember, a knowledgeable attorney may be able to circumvent a coverage exclusion depending on the particular facts of each case. After all, no two cases are identical. This is one reason it is imperative to hire an attorney before you communicate with an insurance adjustor or sign a waiver or similar documents.
