Washington, PA (NewYorkInjuryNews.com) – The Occupational Safety and Health Administration (OSHA) www.osha.gov has fined a construction company after investigating a construction accident where a roofing worker plummeted 40 feet to his death, announced February 12, 2010.
OSHA fined C.A. Franc construction company and roof installation company $539,000 for the companies failure to protect the workers from falls at worksites. OSHA’s investigation of the tragic workers death August 5, 2009 led to the discovery of unsafe working conditions, specifically no fall protection.
“Mr. Franc knowingly and willfully failed to protect his workers from falling to their death,” said Assistant Secretary of Labor for OSHA Dr. David Michaels. “We will not tolerate this type of blatant and egregious disregard for the health and safety of workers.” The company owner, Mr. Franc was cited and fined for failure to properly train the newly hired college student in safety procedures for roofing work, and permitting 10 of his workers to be roofing while not following necessary safety measures.
The company was cited for 10 alleged per-instance willful violations, one for each worker and the untrained new employee totaling $539,000. The general contractor, Hospitality Builders Inc., who worked with C.A. Franc was also cited $70,000 for failure to make sure that C.A. Franc workers had the fall protection.
OSHA’s regional administrator in Philadelphia, Pa stated, “Falls are the leading cause of fatalities in the construction industry. Failure to provide employees with fall protection is unconscionable. We urge construction companies to take the necessary action to ensure their workers are protected.”
