East Pittsburgh, PA (News)—A wrongful death lawsuit was filed against Toyota in connection with a single-vehicle crash that killed a 21-year-old University of Pittsburgh student. The federal lawsuit, filed in Los Angeles, California, alleges the vehicle, which was unaffected by Toyota’s long list of recalls, had a defect in its electronic acceleration system, according to information provided by the New York Post. Reports state the victim of the crash told the dealership that she believed her breaks were not working properly approximately four days prior to the fatal wreck. Dealership employees allegedly checked out her car and proceeded to claim there were no problems with the vehicle.
Tyrene Livingston, 21, was allegedly en route to an internship on October 26, 2007, when her 2007 Yaris hatchback, which was initially traveling in the right-hand lane, careened across all three lanes of the highway, consequently crashing through a barrier and into the woods. The severe injuries she suffered in the motor vehicle accident reportedly proved fatal at the scene. Sandra Livingston, the victim’s mother, filed a wrongful death suit on Monday, February 22, 2010, in response to the devastating incident. The lawsuit allegedly contends, “The troubled carmaker should have provided a mechanical linkage between the accelerator and the engine or a way for the brake to override the system”. Toyota, who has allegedly been sued for four wrongful deaths, would not comment on the pending litigation.
