A Pennsylvania plastic surgeon is facing a lawsuit after giving woman incorrect breast implants and keeping patient under anesthesia longer than necessary.
Pittsburgh, Pennsylvania (NewYorkInjuryNews) – An Ohio woman has filed a lawsuit stating that Pennsylvania plastic surgeon, Dr. Beverly Carl, used the wrong kind of breast implants and then kept her under anesthesia longer than necessary while asking for advice from the plaintiff’s fiancé. Brittany Daly, of Steubenville, Ohio, is seeking $300,000 in damages.
The incident occurred in April 2008. The lawsuit claims that Daly, who was 23 at the time, had been advised by Carl to receive silicone implants, based on their durability over saline. At the time of the surgery though, Carl’s office only had saline implants. Daly claims that the doctor kept her under anesthesia for at least an extra two hours as the doctor attempted to fix the problem by asking Daly’s fiancé for advice. Upon being asked for approval to change the implant filling, Daly’s fiancé, feeling pressure, said to go ahead, even though her treatment plan did not empower him to make such decisions.
Carl refunded $1050 to Daly, apologized and tried to convince her that saline implants were the superior option after the incident. The lawsuit accuses Carl of medical battery, medical malpractice, intentional infliction of emotional distress and false imprisonment. As of Monday, March 15, 2010, the doctor had not responded to requests.
