Legal news for drug-related injury attorneys. A Montana woman files lawsuit against Bayer for Yasmin health affects.
Bayer Pharmaceuticals faces lawsuit concerning Yasmin birth control pills over health problems.
San Francisco Bay, CA—Bayer Pharmaceuticals is facing a lawsuit that contends the drug maker knowingly sold birth control pills that were risky, which led to the plaintiff’s organ failure as a result of taking the pregnancy-preventative drug. The lawsuit was filed in the San Mateo Superior Court, by the plaintiff, Louise Thanos, of Montara, as reported by the San Jose Mercury News.
Thanos, who took the Yasmin birth control pills, also known as Yaz, from November 2007 to November 2009, began having major health problems, which included gallbladder failure. Yasmin has been accused of causing potentially lethal blood clots and gallbladder issues by hundreds of women who have filed similar lawsuits across the country. The suit contends that Bayer knew or should have known that the birth control pills bring a higher risk for strokes, heart attacks, deep vein thrombosis and liver and kidney diseases among users. The U.S. Food and Drug Administration (FDA) http://www.fda.gov/ has previously warned Bayer to state the risks in a more clear form, according to the lawsuit. Bayer was also instructed by the FDA in 2003, 2008 and 2009 not to overstate the pill’s features and downplay the risks in all advertisements concerning the drug. Correcting the misleading statements made by Bayer, led the company to spend $20 million dollars on new ads. The lawsuit calls Bayer’s actions “despicable and so contemptible that it would have been looked down on upon and despised by ordinary people.”
San Jose Mercury Times obtained a statement from Bayer, in which they stated that they are taking the claims and lawsuit seriously; and that the only complaints they have received are result of side effects that are stated in the drug’s labeling. Bayer plans to “defend itself vigorously against these lawsuits.”
