Florida wrongful death attorneys- Walt Disney World faces wrongful death lawsuit with regards to deadly collision involving two monorail trains.

Orlando, FL— Walt Disney World released new investigatory findings and requested a jury trial on Monday, March 22, 2010, in connection with a wrongful death lawsuit filed against the renowned theme park two months ago. The suit stemmed from a fatal July 5, 2009 monorail accident that killed the locomotive’s operator, according to information provided by ClickOrlando.com.

Disney World-employed monorail pilot Austin Wuennenberg, 38, suffered fatal injuries when the monorail train he was operating became involved in a collision with another monorail. Attorneys representing Disney World stated Monday that a monorail maintenance shop worker failed to flip the track switch. Due to the fact the track switch had not been adjusted, when the Monorail Pink conductor was given authorization to reverse onto a different beam, it backed onto the rail, which was already being traveled by the Monorail Purple, subsequently putting the two trains on a collision course. Wuennenberg was pronounced dead at the scene after he sustained traumatic injuries on impact of the monorail crash.

Newly released information revealed the on-site monorail coordinator had gone home sick prior to the deadly collision, prompting another manager to instruct monorail conductors from an off-site location. While Disney World has not admitted any fault in the accident, a jury trial has been requested with regards to the wrongful death lawsuit, filed by the victim’s family.

Reports noted that the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) cited and fined Disney World over $35,000, in correlation with the fatal accident. The National Transportation Safety Board (NTSB) is continuing its probe into the monorail collision.
