California wrongful death attorneys alerts—A wrongful death lawsuit was filed after a boy died at a party where there was underage drinking.
Oakland, CA—A wrongful death lawsuit has been filed by the mother of a teen who died after attending an unsupervised high school party. The lawsuit named the hosts, their parents and a teen who bought the alcohol using a false identification card last April, as reported by the Los Angeles Times.
Marianne Payne claims the death of her son, Joe Loudon, 16, was caused by the “negligence on the part of the students who provided alcohol and of the hosts’ mother and stepfather, Isabel and Scott Hamilton, who were out of town when the party was held without their permission.” After attending the party for less than two hours, Loudon collapsed in a hallway at the party while in front of a couple students. One girl revived him by doing CPR, and then was taken to a bedroom to get some rest. Several minutes went by before Loudon, who was alone, vomited and choked. CPR was administered again and then they immediately called 911. Unfortunately, it was too late.
An autopsy was conducted, which showed there was only a small amount of alcohol in his system at the time. Officials believe that an undiagnosed heart ailment may have been the cause of his sudden and unexpected death.
The hosts of the party, Patrick Gabrielli, 18, and his sister Alexandra, then 19, were fined and sentenced to probation and community service for their part in providing alcohol to minors. The teen who used the fake ID to buy the alcohol was charged and sentenced.
The wrongful death lawsuit is seeking undisclosed monetary compensation for Payne’s loss of her son’s comfort and moral and financial support, which also includes economic damages for his funeral.
