Missouri business litigation: UMB Bank sued for deceptive overdraft practices

Kansas City, MO—UMB Bank was served with a class-action lawsuit based on their alleged participation in unwarranted and wrongful overdraft fee practices. Reports published on Thursday, April 8, 2010, stated these practices, if found to be true, violate Missouri’s consumer protection law as well as contacts between the bank and its customers, according to information provided by NBCActionNews.com.

A Kansas City attorney is representing David Johnson of Cass County, Missouri, in the class-action lawsuit filed against UMB Bank. The lawyer explained that while charging overdraft fees to customers who have withdrawn more money than they have in their bank accounts is indeed justified, charging these fees to those who have adequate funds in their accounts is unacceptable.

The class action lawsuit contended the following:

“(a) engages in a systematic policy of re-ordering debit card transactions from highest dollar amount to lowest dollar amount so as to deplete the customer’s available funds as quickly as possible while maximizing the number of overdraft fees;
(b) charges overdraft fees even in situations where in fact a customer has not overdrawn his checking account;
(c) charges overdraft fees even in situations where UMB in fact did not pay out more funds than were in the customer’s checking account; and
(d) fails to provide accurate account balance information on the bank’s website or at the point of sale.”

Reports did not disclose the extent of compensatory damages sought out through the class-action lawsuit. UMB Bank did not comment on the pending litigation.
