California business litigation attorneys alert- No Doubt wins in latest round regarding their lawsuit with video game maker, Activision, over avatars.
Los Angeles, CA—In the lawsuit against a video game giant, Activision, No Doubt came out the winner in latest round when the Los Angeles County Superior Court gave a tentative ruling rejecting Activision’s defense of freedom-of-speech protections. On Thursday, April 15, 2010 the court handed down its ruling that killed Activision’s defense of its broader use of the No Doubt avatars in the Band Hero game, as reported by the Los Angeles Times.
No Doubt sued Activision in November after the games release, which claimed Activision breached their contract with the band. No Doubt said its contract authorized the use of avatars that represented each of the four band members during the three No doubt songs on the popular Band Hero game. The lawsuit claims Activision made it possible for the avatars to be “unlocked,” allowing players to use the avatars with numerous other songs on the game. No Doubt asserts that Activision breached their contract with the musical group by failing to obtain the required prior written approval for any other uses of the band’s music or likeness.
Activision has the right to appeal the courts ruling should they choose to.
