Sleepy Hollow, NY – In the civil rights trial that never seems to end, a Sleepy Hollow detective admitted on the stand Thursday, July 15, 2010, that he arrested the wife of an alleged beating victim because she was planning to file a complaint against him, as reported by The Journal News.
While Detective Jose Quinoy claimed to have arrested Awilda Gomez for misdemeanors a few hours after a fight that occurred between Quinoy and Mr. Gomez, Mrs. Gomez testified that Quinoy told her it was to cover his faults.
Quinoy told the jury, “I don’t know that I used that exact terminology…I was letting her know it was out of my hands.”
He claimed that because against a police officer could be a precursor to a lawsuit, he had no discretion about whether to arrest her. He reported, “I had to document the incident by doing the arrest.”
Quinoy is charged with violating the civil rights of Mario Gomez during a fight on October 17, 2006. He is also charged with using excessive force against a man by the name of Luis Vilches in an incident that occurred in December 2006. On top of that, he faces charges of witness tampering for attempting to influence the testimony of a fellow officer, Michael Hayes.
During the cross-examination Thursday, the attorney went over phone calls Quinoy made and received immediately before and during the Gomez incident.
