Santa Ana, CA– When a Mission Viejo man bit into his french onion soup at an Orange County Claim Jumper restaurant, the last thing he expected to chew on was a condom, especially a potentially used condom. The unlucky patron is now taking the horrifying incident to court, as reported by KTLA.
Philip Hodousek, 51, his wife, Sherry, and their 18-year-old daughter reportedly went to a Mission Viejo Claim Jumper restaurant for Easter Brunch on April 12, 2009. Houdousek said he ordered a bowl of french onion soup, along with several other menu items.
While eating his soup, he bit down on what he thought was a tough piece of cheese on the side of his mouth. He continued to chew, trying to tear the “cheese,” and told his family that it felt like he was chewing rubber.
Houdousek then spit the “cheese” into his napkin, realizing it wasn’t cheese at all, but a condom. He then vomited in the men’s bathroom.
The restaurant’s general manager, Marc Hadley, came over to their table after Houdousek complained to the waitress, who apologized and explained the item was a rubber glove that was used by the employees who prepared the food.
Houdousek took a picture of the foreign object with his cell phone, wrapped it in a napkin and took it home with him. He then had the condom tested by Lab Corp in North Carolina, which showed there was female DNA. But the restaurant refutes the claims, who has conducted their own testing, but has provided all the results.
Houdousek is now taking the horrifying experience to court, which is set to go to trial on Monday, August 16th. The case is seeking unspecified damages and a public apology from the Irvine-based restaurant chain and any vendor associated with making the soup. Houdousek was originally offered a $30,000 settlement by the restaurant chain, but Houdousek wants to fix his tarnished reputation.
