Antioch, CA (California Injury Lawyer News)—A Brentwood man was arrested and booked after an altercation with a homeless woman took a deadly turn early Tuesday, Dec. 7, 2010. A San Francisco Chronicle report said Lucio Rivera-Avila, 51, was behind the wheel of his parked Nissan Frontier pickup truck when he and Shelly Baker, 47, who was sitting in the passenger seat, began to argue for unknown reasons. The fight spurred Baker to hop out of the vehicle, though it wasn’t long before Rivera-Avila put his truck in reverse and struck her “very hard,” according to police Lt. Leonard Orman. Rivera-Avila was jailed on suspicion of murder.
Shortly before 1:50 a.m., an argument broke out while Rivera-Avila and Baker sat in Rivera-Avila’s pickup truck, which was stopped in the parking lot of a produce store, located at 1725 Cavallo Road. Rivera-Avila then swiftly backed up and hit Baker. The homeless woman was dragged approximately 50 to 75 feet after the initial impact. Lt. Orman said nearby surveillance cameras captured the horrific incident, which he described as “clearly intentional,” on tape. Rivera-Avila sped away from the scene after the crash.
While emergency medical services (EMS) personnel rushed Baker to the hospital after the malevolent dragging incident, her injuries proved fatal shortly after. Additionally, police officials discovered the suspect’s pickup truck parked outside a drugstore on East 18th Street around 8:45 a.m. Rivera-Avila, who was sentenced to 36 days in jail and three years probation in connection with a 1994 domestic-battery incident, was arrested and booked into an unspecified jail. Reports stated Rivera-Avila’s previous conviction, assault with a deadly weapon, stemmed from a violent episode that took place in San Francisco.
