U.S. Border Patrol sued for $25M over fatal shooting of 15-year-old Mexican teen

El Paso, TX—The U.S. Border Patrol has been sued by the family of a fatally shot 15-year-old Mexican boy, for allegedly throwing rocks at agents. The $25 million wrongful death and civil rights violation lawsuit was filed in El Paso on Monday, January 17, 2011, reports Fox News Latino.

According to the lawsuit, U.S. Border Patrol agents shot Sergio Adrian Hernández Guereca, on June 7, while the agents were arresting illegal immigrants crossing the bed of the Rio Grande. A group of people on the Mexican side were throwing rocks at the agents, said FBI spokeswoman Andrea Simmons. Agents are generally permitted to use lethal force against people who are throwing rocks.

The identity of the agent who shot Guereca has not been revealed.

Witnesses deny that there was any rock-throwing.

Guereca’s family is seeking $25 million in damages.

The case is underway.
