Orlando, FL—A California family has filed a lawsuit against Walt Disney Parks and Resorts after their son was badly burned by scolding nacho cheese, which spilled on him while visiting the Magic Kingdom. The lawsuit was filed in a California District Court on Wednesday, February 9, 2011, as reported by CBS News.

Isaiah Harris, 4, suffered second- and third-degree burns from hot nacho cheese that he somehow spilled on himself, while trying to eat dinner during their visit to the Magic Kingdom’s Tomorrowland on March 17, 2010. The family reportedly had dinner at Cosmic Ray’s Starlite Café.

Isaiah was treated for burns at an Orlando-area hospital following the accident. He reportedly is still being treated for the burns 11 months later.

Attorneys representing the victim claim the nachos did not come with any warning of the food’s temperature. In addition, the family asserts that Disney did not take their son’s injuries seriously.

“It’s unfortunate when any child is injured. We just received notice of this lawsuit and we’re currently reviewing it,” Disney said in a statement.
