Injured Worker Sues BP Cherry Point Refinery Over Accident

Whatcom County, WA — BP West Coast Products is facing a lawsuit filed by a contract worker who suffered injuries on the job over two years ago. The lawsuit, which was filed in the Whatcom County Superior Court, alleges that BP was negligent in taking precautions that could have prevented the accident, reported the Bellingham Herald.

Randy Allen Jones was working for Coastal Industrial Services Inc., at the Cherry Point refinery on April 27, 2009, cleaning vessel tanks when he stepped into a concealed drain, causing him to fall.

The lawsuit asserts that the fall left him with “permanent impairment and disabling injuries…which include injuries to his left ankle, right ankle and back.” These injuries have caused the plaintiff to incur medical expenses, lost wages and permanent pain.

BP was negligent in failing to employ precautions that could have prevented the accident. BP also violated state and federal workplace safety regulations, the lawsuit charges.

The lawsuit also revealed that Jones has already received $39,010 in medical aid and $96,826 in lost wage benefits from the Washington Department of Labor and Industries.
