A Bronx teenager, enjoying a late night bicycle ride on Friday, July 13, 2012, was struck from behind by a 2001 Nissan Maxima, in a hit and run accident. David Ellis, age 18, was riding his friend’s bicycle northbound on Webster Avenue in the Williamsbridge section of the Bronx when a Nissan Maxima struck him from behind throwing him off the bicycle and into the southbound lane where he was struck and killed by another vehicle, an oncoming Ford Explorer. The driver of the second vehicle, the Ford Explorer stayed at the scene of this tragic car accident. Mr. Ellis who was hoping to receive a football scholarship was known as an ‘ideal person‘ according to his sister Tara, age 24.
The case is being investigated by the New York Police Department to determine the identity of the driver of the Nissan Maxima, as well as for the results of the accident reconstruction investigation that is required in all fatal accidents occurring in New York.
According to New York City car accident lawyer, Jonathan C. Reiter, who has handled many car-bicycle accidents, there are many relevant facts that remain to be seen pending the accident investigation’s findings. Mr. Reiter stated: “the issues which will be answered by the police accident investigation revolve around the location of the bicycle when the initial impact occurred. Since there are bike lanes located on Webster Avenue, it is a key factor in this investigation to determine whether the bicyclist was struck while in a bike lane or in another location on the roadway. In addition, the police will be looking into the roadway’s lighting, and whether all lighting was operational at the time of the accident, as well as whether the bicycle was equipped with proper lighting and reflective devices which are required by New York State law.” There are also issues of liability of each of the drivers involved in this accident, that of the Nissan Maxima, and in addition, that of the driver of the Ford Explorer. Mr. Reiter went on to state: “ The driver of the Nissan clearly struck the bicycle, starting an unbroken chain of events that caused the bicyclist to be thrown into the oncoming lane of traffic where he was then struck for a second time, resulting in his death.” The preliminary investigation of this accident has not revealed further details, which Mr. Reiter states are crucial to the analysis of this accident and to the proximate cause of Mr. Ellis’ death.
