Papa John’s faces class action lawsuit for text blasts

US – Popular pizza chain Papa John’s is facing a multimillion-dollar class action lawsuit for allegedly sending out text message spam. As reported by CNN Money, the $250 million lawsuit alleges customers were sent 500,000 unsolicited text messages in 2010 related to pizza deal offers.

Erin Chutich, a plaintiff in the case, is quoted in the report as saying in a statement, “After I ordered from Papa John’s, my telephone started beeping with text messages advertising pizza specials… Papa John’s never asked permission to send me text message advertisements.”

The text blasts were reportedly sent by OnTime4U, a text messaging service also named as a defendant in the case.

As noted in the report, companies are barred by the Telephone Consumer Protection Act of 1991 from disseminating text message advertisements that consumers do not opt in to receive.
