Washington, D.C. – A decision is pending in the U.S. Supreme Court regarding an international custody battle between a U.S. soldier and his wife, from whom he is now separated. As reported by the Associated Press (AP), justices sought to find middle ground this week in the dispute over Army Sgt. 1st Class Jeffrey Lee Chafin’s right to appeal a federal decision in which Lynne Hales Chafin was allowed to take their child to Scotland to live, where she has been for over a year.
The 11th U.S. Circuit Court of Appeals ruled that further judiciary action would be up to the Scotland courts. Some justices are concerned; however, about the outcome of the case with regards to foreign-born parents being able to elude jurisdiction in U.S. courts by leaving prior to final court decisions in custody battles being made.
A decision by the Supreme Court is expected to be made in the spring.
