Flint, Michigan – A woman has filed a lawsuit against a Michigan hospital after it purportedly granted a man’s request to not have any African-American nurses care for his child. As reported by the Clarion Ledger, Tonya Battle, 49, who has been an employee of Hurley Medical Center in Flint for almost 25 years, filed the suit after stating she was reassigned when a father told a charge nurse he did not want her or other black nurses caring for his infant.
Larry Dubin, a law professor at University of Detroit Mercy School of Law, is quoted in the report as stating of the case, “The patient’s father has the right to select the hospital to treat the child. The father does not have the right to exercise control over the hospital in discrimination of its employees.”
Battle is suing for humiliation, damage to her reputation, and other damages.
