A Texas man who was implanted with two recalled Stryker ABG II hip implants has filed a lawsuit in New Jersey Superior Court against Stryker Orthopaedics (Docket No. L-910-13). The lawsuit, which was filed on February 1, 2013, alleges that the two Stryker hip implants he received are defective and caused him to suffer serious injuries.
Stryker Hip Recall Lawsuits Consolidated in Bergen County, New Jersey Superior Court
Several cases have been filed against Stryker Orthopaedics and its parent company, Howmedica Osteonics Corporation, by patients who allege that they experienced complications due to defective Stryker ABG II and Rejuvenate hip implants. Lawsuits filed against Stryker in New Jersey have been consolidated in New Jersey Superior Court in Bergen County into what is known as “multicounty litigation.” All Stryker hip implant recall lawsuits that allege injuries due to the ABG II or Rejuvenate implants and that are filed in New Jersey will now come before Judge Brian R. Martinotti.
Texas Man Alleges Defective Implants Required Two Revision Surgeries
The Texas man originally underwent a total right hip replacement on March 31, 2010 because of his history of osteonecrosis and arthritis. He was led to believe that the Stryker ABG II would work well for him because of his young age and need for a durable hip implant. On February 2, 2011 he underwent a second total hip replacement on his left hip and received a second Stryker ABG II hip implant.
Just months later, the Texas man began to experience pain at the implant sites and difficulty walking. In the first week of July 2012, Stryker issued a voluntary recall of the Rejuvenate and ABG II modular neck hip stems, citing reports of device failure due to heavy metal fretting and corrosion. By this time, the Texas Plaintiff’s doctors knew that his implants were causing high metal ion levels in his blood and were loosening.
In a revision surgery on October 16, 2012, the Stryker ABG II was removed from the Texas man’s right hip in a grueling operation. He endured months of physical therapy following, only to have his left Stryker ABG II implant removed on January 22, 2013.
Texas Man’s Wife Files Loss of Consortium Claim
Joining in the lawsuit is the man’s wife who has been with him and has taken care of him following two grueling revision surgeries and physical therapy. As a result of her husband’s injuries, she has had to take care of him and has been unable to find employment.
The Texas man and his wife are being represented by hip implant recall attorney Kay L. Van Wey of Van Wey Law, PLLC in Dallas, Texas. Ms. Van Wey has associated with local counsel in New Jersey to bring the lawsuit. “I have several clients who have needlessly suffered because these medical devices were placed on the market without proper research.
