Las Vegas – An Oregon police officer who was fired for drunk driving is alleging the firing was in violation of the Americans with Disabilities Act. As reported by the Associated Press (AP), Jason Servo filed a lawsuit claiming he was suffering from alcoholism, which is recognized as a disability under the act, and should not have been fired.
Shawn Kollie, an attorney for Servo, is quoted by the AP as stating in reference to the case, “Just as with any type of disability or disease, they should have made some kind of effort to accommodate that, or some kind of effort to work with him, and not simply sever all ties.”
Servo, who says he is now more than 800 days sober after entering an in-patient program for treatment, was diagnosed as being an alcoholic.
The lawsuit alleges Servo’s firing from the Gresham police department was attributed to a “funding issue.”
