Albany, NY – The New York State Court of Appeals mulled over liability standard issues in personal injury cases involving domestic animal injuries. As reported by Reuters, the court reviewed two cases against the owner of a horse and the owner of a cow who had been sued for negligence after their animals were accused of causing injuries to others.
In the case of the cow, Karen Hastings had filed a negligence lawsuit after she crashed her van into it when it strayed onto the road in 2007. The appeals court held that landowners or animal owners could be found liable when farm animals are negligently permitted to stray from their property.
In a separate case, claims brought by Robert Bloomer, who filed a personal injury lawsuit after purportedly becoming injured by a neighbor’s horse when he attempted to calm the animal, were dismissed by the court.
The Court of Appeals determined that the animal’s behavior was not typical or vicious as the lawsuit alleged.
