Supreme Court upholds FCC rule in cellphone tower case

Washington – The Supreme Court upheld a rule adopted by the Federal Communications Commission regarding a time frame placed on approving applications for new wireless phone antennas on Monday. As reported by the Los Angeles Times, the High Court voted 6-3 in the decision about the rule, which was challenged by two cities in Texas and two in California.

The rule stipulates that cities and counties have 5 months to decide whether an application for erecting new wireless phone antennas will be approved. The ruling is deemed a victory for the wireless industry.

Michael Altschul, general counsel for CTIA-the Wireless Assn., is quoted in the report as stating that local decisions in accordance with the rule are to be made within “reasonable time frames and help the industry deliver fast and reliable service to all Americans.”
