California – A California woman has filed a lawsuit against a veterinary office that accused her of animal cruelty when she was purportedly unable to afford a $10,000 surgical procedure for her pet. As reported by ABC News, Karen Kelly filed the $1 million suit against Advanced Critical Care and Internal Medicine Inc. with the California Superior Court in Orange County, alleging the practice used extortion by threatening to make a report against her if she failed to pay for the surgery for her dog.
Kelly took her dog, Mojo, to the facility after it was hit by a car in 2011. She was told that the dog would require immediate surgery, but his survival after undergoing the $10,000 procedure was not guaranteed.
Kelly signed an agreement to pay a $1,308.75 bill associated with what the facility had already done for the dog.
The lawsuit is quoted as stating of her signing the agreement, “[Kelly] signed the agreement under severe duress, as that was the only way that she could get her dog back, even though she knew that she would not be able to pay the entire amount in full by the following day.”
Kelly is seeking damages in the case for civil extortion, intentional infliction of emotional distress and negligent infliction of emotional distress.
