London – A British court has ruled that a man unable to give informed consent should have a vasectomy, stating it was in his “best interests.” As reported by the Associated Press (AP), the man, 36, referred to as DE, has a 40 IQ and according to the ruling of the court, insisted he wanted no more children after he and his girlfriend, who also has learning disabilities, had a child in 2009.
DE’s parents and doctors applied for the procedure on his behalf due to his mental capacity. This is reportedly the first time Britain’s Court of Protection has ruled to authorize a vasectomy on the grounds that it is in the best interest of the man.
Penney Lewis, a legal ethics expert at King’s College London, is quoted by the AP as stating, “This is not a decision the court made lightly…This is a man who already has a child and has repeatedly expressed his opinion he does not want any more.”
