Michigan – The Supreme Court is examining an amendment to Michigan’s state constitution pertaining to a voter ban on affirmative action. As reported by the Associated Press (AP), justices in the high court will consider whether the ban is discriminatory.
An attorney for pro affirmative action civil rights groups recently suggested that illustrating that the change is discriminatory may be difficult. Mark Rosenbaum of the American Civil Liberties Union, who was set to make an argument to the court on Tuesday, is quoted by the AP as stating, “How can a provision that is designed to end discrimination in fact discriminate?
“This is a case about means, not about ends. It is not about whether a state can choose not to have” affirmative action.
Michigan Attorney General Bill Schuette, whose office is defending Proposal 2, the measure in question, is further quoted as stating, “We are saying no preferences. We’re not discriminating. We’re saying equal treatment.”
