Superior, WI (News)—A wrongful death lawsuit was filed against Lake Nebagamon Trucking Corporation Inc., a semi-truck driver, as well as Security National Insurance Company, the firms’ insurer, in connection with a motor vehicle collision (MVC) that left one woman fatally injured on December 11, 2009. The woman’s husband hired a wrongful death attorney who filed the suit in Douglas County Clerk of Courts Office last week, according to information provided by SuperiorTelegram.com.
A 29-year-old woman from Solon Springs, Wisconsin, identified only as Phillips, was allegedly traveling north when a southbound big rig, driven by Troy A. Rasmussen, apparently veered over the centerline, violently striking her head-on. Phillips was sadly pronounced deceased at the scene of the two-vehicle crash. Emergency medical services (EMS) crews seemingly transported Rasmussen to an area hospital to undergo treatment by doctors and nurses for the undisclosed injuries he suffered in the wreck. Reports state the 18-wheeler driver underwent surgery a few days later. According to officials from the Superior Police Department, Rasmussen may have blacked out before the fatal crash occurred.
The suit reportedly contends “one count of negligence against Rasmussen, one count of vicarious liability against Lake Nebagamon Trucking, which owns the semi-tractor trailer, one count of negligent entrustment against the trucking corporation and one count of breach of motor carrier safety regulations against both Rasmussen and Lake Nebagamon Trucking”. The suit seemingly alleges that the trucking firm had partial liability in the fatal incident since they were reportedly aware of Rasmussen’s medical conditions and aforementioned reports of his driving performance but evidently chose to ignore such factors.
