Oakland, CA — An Alameda County Superior Court jury has awarded a young woman who was run over by an AC Transit bus $10.5 million on Monday, September 12, 2011. This settlement marks the largest injury settlement reached with AC Transit, reported the San Jose Mercury News.
Abby Nichols, 23, was ran over in an Oakland cross walk in 2008, leaving her with permanent nerve damage, which requires her to walk with a cane.
Nichols was trapped under the bus for over 15 minutes because the driver did not know how to activate a hydraulic device to free her.
As a result of the bus accident, Nichols was left with a crushed hip that had to be replaced, and a broken pelvis and femur.
AC Transit fired the bus driver involved in the pedestrian accident after they determined the driver was at fault.
The accident occurred when Nichols went to cross Telegraph Avenue at 51st Street at 6:15 p.m., on November 3, 2008. Nichols had reportedly entered the crosswalk on a green light when the bus driver made a right turn and struck her in the crosswalk.
Nichols is undergoing physical therapy and still requires additional surgeries.
