New York Injury Accident Lawyer Report: A 24-year-old bicyclist, who was a drummer in a popular Brooklyn indie band, was struck and killed by a truck in a hit-and-run accident on a busy stretch of Metropolitan Avenue in the early morning hours of October 1, 2012. The driver of the truck did not stop and is being sought by police investigating the accident.
The bicyclist, identified as Terence Connor was on Metropolitan Avenue, near Steward Avenue in the East Williamsburg section, at 5:15 am when he was struck. Emergency crews removed him to Woodhull Hospital where he died of his wounds. His grief-stricken mother, Shelly Connor, was quoted by news sources as saying that ‘he had so many friends.” The victim played in the band known as “Total Slacker” a popular band which had recently begun to record their second album, a follow-up to their inaugural album “Trashin.” Aside from being a talented musician, Terence also worked at a talent agency and did some modeling, according to unnamed family sources.
According to New York personal injury and pedestrian accident attorney, Jonathan C. Reiter, who has handled many truck accident cases, the fact that the truck did not stop at the site of the accident is in violation of New York State’s hit-and-run statutes which make it a felony to leave the scene of a serious accident. Mr. Reiter stated: “ This stretch of Metropolitan Avenue is known as a highly dangerous area, due to a high volume of car and truck traffic. The truck has the duty to operate his truck in a reasonably safe manner based on the conditions at the time of the accident, including traffic and lighting conditions of the roadway, as well as to comply with the applicable traffic laws and regulations. The driver of the truck has the duty to see what is there to be seen in the roadway, including the bicycle, and to exercise caution in avoiding a collision. The fact that the truck driver could hit this young man, and leave the scene, is not only illegal conduct, but may also be significant of the driver’s consciousness of guilt in causing this tragic accident.”
The New York Police Department is investigating this accident, and searching for the driver of the truck, which will shed light on the many outstanding issues as stated by Mr. Reiter. As Mr. Reiter concluded, “in this day and age of video cameras on many street corners, it is only a matter of time before the driver is located. At that time, the police will inspect the truck for evidence of collision with the bicycle and take a statement from the driver, in their efforts to determine how this accident occurred.” Until that time, the facts of this accident remain largely unknown.
