Columbus, Ohio – A 450-pound death row inmate is fighting execution, claiming his weight would make it an excessively painful process. As reported by the Associated Pres (AP), Ohio death row inmate Ronald Post is seeking to stop his execution scheduled for Jan. 16, due to anticipated complications; however, state officials say he can be humanely executed using the state’s methods.
Post is on death row for the death of a motel clerk during a robbery in 1983. He claims an execution attempt would constitute cruel and unusual punishment due to his obesity.
Post’s attorneys are quoted as asserting in court documents, “Given his unique physical and medical condition there is a substantial risk that any attempt to execute him will result in serious physical and psychological pain to him, as well as an execution involving a torturous and lingering death.”
Assistant Attorney General Charles Wille is further quoted as stating in court papers the inmate has yet to present, “sufficient evidence demonstrating that his obesity or other physical conditions will present a substantial risk that his execution cannot be conducted in a humane and dignified manner.”
