Texas wrongful death lawyer-Brian A. Eberstein-files Taser death lawsuit asserting Fort Worth police used excessive force!

Texas wrongful death attorney-B. Eberstein-sues Fort Worth police officer and City of Fort Worth after taser shocks by police ruled a homicide.

Dallas taser injury lawyer-Brian A. Eberstein-filed a lawsuit today naming the City of Fort Worth and Fort Worth Police Department Officer, Stephanie A. Phillips. The Texas taser attorney, who represents the family of Michael Patrick Jacobs, Jr., a young man who died after suffering multiple electrical shocks from a Taser stun gun, alleges the gross negligence of the named defendants caused the wrongful death of 24 year-old Michael on April 18, 2009.

According to court documents filed in the U.S. District Court for the Northern District of Texas, Fort Worth Division, Michael died when members of the Fort Worth Police Department, an agency under the City of Fort Worth, used excessive force. Apparently, the officers administered a 49 second continuous Taser shock of 50,000 volts to a non combative, mentally disabled man in his home. The Tarrant County Medical Department ruled Michael’s death a homicide and the family’s personal injury attorney asserts the Fort Worth Police Department’s use of excessive force with a Taser was a violation of Michael’s Constitutional rights. Officer Phillips, a corporal with the department, shocked Michael, with a Taser for 49 seconds and then administered an additional 5 second shock after a 1 second interval. Michael was lying face down on the ground with his hands across his chest for some 49 seconds while the officer continued to administer the continuous electrical shock of 50,000 volts.

The Dallas taser injury attorney, Eberstein, says the unprovoked attack by the Fort Worth Police Department, against the decedent, Michael Patrick Jacobs, Jr., who lived with his mother, was clearly excessive and grossly negligent by law enforcement professionals. The wrongful death suit also asserts the City of Fort Worth continuously failed to properly train and supervise its police officers in the proper use of Tasers because there were three similar deaths before Michael’s involving taser shocks by police. The unnecessary use of the Taser by the Fort Worth Police Department officer was clearly unnecessary and the failure of the City of Fort Worth to properly train and supervise its officers in Taser use also constitutes gross negligence and caused the death of Michael. The plaintiffs request for a trial by jury and recovery from the damages and injuries caused by the defendants was submitted to the court on Monday, August 31, 2009 in Tarrant County, Texas.

Excessive use of force by police officers, when using a Taser gun is taking lives, not saving lives.
