Essex County, NJ — A July 2006 car accident has resulted in a $4.2 million award following a lawsuit against Nissan Automotive. An Essex County jury awarded the judgment to a 52-year-old Hillside man whose neck was fractured as a result of a runaway tire, WestOrangePatch.com reported.
Larry Clanton, a United States postal worker at the time, was driving to the shore when a 73-lb runway tire from a pickup truck traveling in the opposite direction hit his Nissan Altima’s rood and cracked it.
The impact pushed Clanton’s head forward, which fractured his neck as his chin was pushed into his chest.
Clanton’s attorneys argued in court that the roof panel and the header panel in all 2002-2006 Nissan Altimas are defective, as they are improperly attached to the rest of the roof structure.
They also asserted that Clanton’s injuries were completely preventable if the header that forms the front of the roof has been attached to the sides of the roof’s steel skeleton—a common practice in most vehicles.
