California – The attorney providing representation for plaintiffs lawyer Steven Donzinger in a lawsuit filed by Chevron Corp alleging fraud has filed to withdraw as counsel. As reported by Reuters, Attorney John Keker filed the motion Friday citing Donzinger was unable to pay his legal bills.
Chevron filed the lawsuit against Donzinger alleging he committed fraud in bringing forth a legal claim against the corporation for purported pollution of a rainforest in Ecuador. Chevron is seeking to have a related $19 billion judgment overturned.
Keker is quoted by Reuters as stating of Chevron and New York federal court Judge Lewis Kaplan in the motion, “Chevron’s litigation tactics, which this court has endorsed and encouraged throughout these proceedings … have made the costs of this litigation unsustainable to Donziger.”
“More significantly, to even stay alive in this case … will cost another six to ten million dollars in attorney time and costs. With revenues in the billions of dollars, Chevron can afford to litigate this case ‘until hell freezes over.’ But Donziger can’t,” Keker further asserts.
