Boston, MA–Boston and Worcester federal courts received proposed class-action lawsuit filings against five major health care providers in the state of Massachusetts on Thursday, September 3, 2009. Over 500 current and former employees represented by New York employment law attorneys claimed they were not paid for hours worked. The hospitals named as defendants, by New York employment law lawyers representing 500 of the estimated 72,800 eligible workers, were Boston Medical Center, UMass Memorial Health Care, Partners Healthcare System, Caritas Christi, and CareGroup Inc., as reported by the Boston Herald.
According to reports in the Boston Herald based on court documents filed by attorneys representing the wronged workers, the hospitals were accused of systematically not paying employees for legitimately worked overtime pay. The lawsuit claims failure by hospital administrators and managers to pay workers for time worked before and after their regularly scheduled shifts shorted employees on employer contributions to their retirement plans like 401(k). Employees also claimed they worked through lunch breaks and the hospitals failed to pay them for the actual hours they worked. The recent allegations is the beginning of the workers claims through the federal court systems in Massachusetts.
